Vivid Water Damage & Restoration (“Vivid,” “we,” “us,” or “our”) collects, uses, and safeguards personal information as part of delivering IICRC-certified water damage restoration, mold remediation, sewage cleanup, and reconstruction services across Salt Lake County. This Privacy Policy describes what data we collect from clients, prospective clients, website visitors, and third parties involved in the insurance-claim workflow — and how that data is used, shared, retained, and protected. The policy is written to comply with the Utah Consumer Privacy Act (UCPA), effective December 31, 2023, and applicable federal privacy law.

Information We Collect

The categories of personal information Vivid collects fall into four operational groups tied to how restoration work actually gets done.

Contact and Identity Information

  • Full name, mailing address at the loss site, mailing address for billing (if different), telephone number, and email address.
  • Property ownership status (owner, renter, property manager, tenant) required for work authorization under Utah DOPL rules.
  • Emergency contact information provided by the client for extended projects.

Loss-Specific and Technical Data

  • Dated photographs of the loss location, damage envelope, and remediation progression. EXIF metadata (including GPS coordinates confirming on-site presence at the loss address) is preserved as required for ANSI/IICRC S500 Section 12 documentation.
  • Moisture meter readings, thermal imaging captures, psychrometric log entries (temperature, relative humidity, grains per pound of water vapor), and negative-pressure differential readings on mold remediation projects.
  • Written technical narratives, Xactimate scope documents, and any correspondence with the client relating to the scope of restoration work.

Insurance and Financial Information

  • Insurance carrier name, policy number, claim number, and adjuster contact information.
  • Direct-billing authorization forms and any assignment of benefits (AOB) documentation the client executes.
  • Payment information for out-of-pocket work — check, ACH, or credit card details are processed through PCI-DSS-compliant third-party payment processors (currently Stripe and Square) and are not stored on Vivid systems.

Website and Analytics Data

  • IP address, browser type and version, device type, operating system, referring URL, pages visited, and time on page.
  • Cookies and similar tracking technologies set by the website content management system (WordPress) and integrated analytics tools (Google Analytics 4, Google Site Kit).
  • Form submissions from the contact page, including any information the visitor voluntarily provides.

How We Use Your Information

Personal information collected under this policy is used for the following defined purposes:

  • Service delivery. Dispatching the appropriate IICRC-certified technician, coordinating equipment (Dri-Eaz refrigerant dehumidifiers, Phoenix DryMAX LGR units, air movers, air scrubbers, moisture meters), and executing the restoration scope from initial extraction through final psychrometric verification.
  • Insurance carrier coordination. Submitting documentation packages to the client’s insurance carrier or public adjuster in the form the carrier requires (typically Xactimate scope, PDF photographic record, and written technical narrative).
  • Regulatory compliance. Meeting documentation requirements under Utah DOPL contractor rules, EPA Lead-Safe Renovator (RRP) requirements for pre-1978 housing, OSHA safety compliance on job sites, and Salt Lake County Health Department requirements on Category 3 sewage remediation.
  • Communications. Sending appointment confirmations, project status updates, invoices, and post-project follow-up. Marketing communications are only sent to clients who have opted in and can be unsubscribed at any time.
  • Website operation and improvement. Understanding how visitors navigate the site, identifying pages that need improvement, and diagnosing technical issues.

How We Share Your Information

Vivid does not sell personal information. Vivid does not share personal information for cross-context behavioral advertising as defined under the Utah Consumer Privacy Act. Personal information is shared only with the following categories of third parties, and only for the specific purposes described.

Insurance Carriers and Adjusters

When a client authorizes Vivid to bill their insurance carrier directly, we share the loss documentation package with the named carrier and its assigned adjuster. Common carriers we work with include Progressive, USAA, State Farm, Allstate, Farmers, Bear River Mutual, American Family, and other major U.S. carriers writing policies in Utah. When a third-party adjuster or estimator network handles the claim (Sedgwick, Alacrity Solutions, Contractor Connection), that entity receives the same documentation.

Independent Industrial Hygienists

Mold remediation projects under ANSI/IICRC S520 require post-remediation verification by an independent industrial hygienist. When the client engages an independent hygienist, we share the containment perimeter documentation, HEPA scrubber runtime logs, and negative-pressure differential readings with that hygienist so their air-sampling verification is grounded in the actual remediation record.

Subcontractors and Trade Partners

Reconstruction phases involving electrical, plumbing, HVAC, roofing, or specialty trades may require licensed subcontractors. Vivid shares only the information necessary for the subcontractor to complete their scope: the loss address, the scope-of-work document, the client’s contact information for scheduling, and any relevant technical details from the moisture map.

Government Agencies

Salt Lake County Health Department has jurisdiction over Category 3 sewage remediation and may require documentation submission before re-occupancy sign-off. Utah DOPL may audit contractor records during license renewal. Municipal building departments in Salt Lake City, Cottonwood Heights, Holladay, Sandy, Millcreek, Murray, Midvale, and South Salt Lake receive permit-related documentation when reconstruction work requires a permit.

Legal Compliance

Vivid may disclose personal information when required by court order, subpoena, or other legal process, or to defend the company’s legal rights in a claim dispute.

Data Retention

Project documentation is retained for a minimum of seven (7) years from the date of project completion. This retention window aligns with the insurance industry’s typical statute of limitations for property claim reopening and with Utah civil litigation limitations periods for negligence and breach of contract claims. After seven years, project documentation may be archived to offline storage or securely destroyed at Vivid’s discretion unless the client requests continued active retention. Website analytics data is retained per the default Google Analytics 4 configuration (26 months for user and event data). Contact form submissions from prospective clients are retained for 24 months and then purged.

Your Rights Under the Utah Consumer Privacy Act

Utah residents have the following rights under the UCPA effective December 31, 2023:

  • Right to access. You may request confirmation of whether Vivid is processing your personal information and access to the personal information we hold about you.
  • Right to delete. You may request deletion of personal information you provided to Vivid, subject to legal retention requirements. Note that project documentation subject to the seven-year retention window cannot be deleted before that window closes.
  • Right to data portability. You may request a portable copy of the personal information you provided to Vivid in a format that allows you to transmit that information to another entity.
  • Right to opt out of sale. Vivid does not sell personal information, so this right does not require an active response.
  • Right to opt out of targeted advertising. Vivid does not engage in cross-context behavioral advertising as defined under UCPA.

Data Security

Personal information is stored on encrypted servers with access limited to authorized Vivid personnel who have a defined operational need for the data. Photograph and documentation packages are stored on Google Workspace with two-factor authentication enabled on every user account. Payment card data is not stored on Vivid systems; card transactions are processed through PCI-DSS-compliant third-party processors. Physical documentation (any paper work-authorization forms, subcontractor agreements, and insurance-related paperwork) is stored in locked file cabinets at the Fort Union office at 7084 S 2300 E #170, Salt Lake City, UT 84121. In the event of a data breach affecting personal information, Vivid will notify affected individuals and the Utah Attorney General’s office as required by Utah Code § 13-44-202.

Cookies and Website Tracking

The Vivid website uses cookies and similar tracking technologies for the following purposes: (1) essential functionality, including session management for the WordPress content management system; (2) analytics, through Google Analytics 4 and Google Site Kit, to understand aggregate visitor behavior; (3) form submission handling for the contact page. No third-party advertising cookies are set. Visitors can disable cookies through their browser settings; disabling essential cookies may prevent the contact form from functioning correctly.

Children’s Privacy

Vivid’s services are directed at property owners, renters, and property managers — adults with the legal capacity to authorize restoration work on a property. We do not knowingly collect personal information from children under 13. If a parent or guardian believes their child has provided personal information to Vivid, contact us at the address below and we will delete the information.

Changes to This Policy

Vivid may update this Privacy Policy from time to time to reflect changes in operations, legal requirements, or industry practice. The “Last Updated” date at the top of this policy indicates when the most recent changes were made. Material changes affecting how personal information is collected, used, or shared will be communicated to clients with active projects via email and posted on this page.

Does Vivid share my information with my insurance carrier automatically?
Only when you authorize direct billing to your carrier. If you pay for restoration work out of pocket, no information is shared with an insurance carrier unless you request it. When you do authorize direct billing (typically via a signed work-authorization form or assignment of benefits document at the start of the project), the loss documentation package is delivered to the named carrier and its assigned adjuster.
Is my payment information stored on Vivid systems?
No. Payment card data is processed through PCI-DSS-compliant third-party processors (currently Stripe and Square) and is not stored on Vivid systems. ACH bank transfer information is retained only for the duration required to complete the payment cycle. Physical payment documentation (paper checks, wire transfer records) is stored in locked file cabinets at the Fort Union office and destroyed on the seven-year retention cycle described above.
